Health care products can be sold over the counter, such as vitamins or cosmetics, or by physician prescription. Many such products must be established to be safe and effective for their intended use before they can be sold to the public.

Most prescriptive productions must go through a rigorous pre-market approval process by the U.S. Food and Drug Administration before they can be sold to the consuming public. Some prescriptive products can be defective because they are not labeled or formulated correctly. Some drugs interact with others producing dangerous side effects. Some drugs present health risks to some people. Some medical devices such as artificial joints and pace makers can fail and break due to a defect.

Manufacturers are required to test for such dangers and warn the public about health risk associated with use of their products, whether they are prescriptive drugs, implanted medical devices, or cosmetic products.
